Cùng với sự phát triển của thương mại quốc tế, các quy tắc giao hàng trong Incoterms ngày càng được sử dụng phổ biến như một giải pháp rút ngắn thời gian đàm phán hợp đồng ngoại thương, phòng tránh những rủi ro, mâu thuẫn, tranh chấp phát sinh trong quá trình giao nhận hàng hóa. Vậy lựa chọn quy tắc giao hàng nào để đưa vào hợp đồng sao cho phân chia đầy đủ nghĩa vụ và đảm bảo quyền lợi cho các bên cũng như đạt hiệu quả tốt nhất cho thương vụ là vấn đề đặt ra mà người xuất khẩu, nhập khẩu đặc biệt cần quan tâm khi ký kết hợp đồng. Bài viết giới thiệu về Incoterms 2020 và phân tích các nhân tố ảnh hưởng tới sự lựa chọn quy tắc giao hàng, trên cơ sở đó đề xuất các giải pháp nhằm nâng cao hiệu quả sử dụng Incoterms 2020 trong thương mại quốc tế.

English Summary:

Along with the development of international trade, Incoterms rules are being utilised more frequently as a solution to reduce the duration of foreign trade contract negotiations and prevent risks, conflicts, and disputes that arise during the delivery of goods. Therefore, the selection of delivery rules in Incoterms being incorporated into the contract to ensure the rights of the parties, fully divide the obligations and optimise the deal is a major concern of exporters and importers when executing the agreement. The following article provides an overview of Incoterms 2020 and an analysis of the factors that influence the selection of delivery rules. Based on the analysis, this research suggests solutions to enhance the efficiency of Incoterms 2020 in international trade.
